2. User Accounts and Eligibility

Compliance Obligations

As a LeadScan user, you must:

4. Intellectual Property Rights

We own and retain all rights to:

  • The LeadScan platform, software, and technology
  • AI algorithms, models, and conversation analysis systems
  • Lead scoring and qualification methodologies
  • Platform interface, design, and user experience
  • Documentation, training materials, and support content
  • Trademarks, service marks, and brand assets

Your Content and Data

You retain ownership of:

  • Your business content, marketing materials, and company information
  • Customer relationships and business leads generated through your operations
  • Data you provide during account setup and service configuration

Shared Data Rights

For lead data extracted through our AI analysis:

  • You have the right to access, export, and use lead information for your business

  • Lead intelligence and scoring remain available to you during your subscription period

5. Subscription Plans and Billing

Subscription Terms

  • Account termination within 7 days of initial subscription (first-time customers only)

Refunds are not available for:

  • Failure to achieve expected business results
  • Third-party integration issues beyond our control

6. AI Services and Limitations

  • Contact information extraction may be incomplete or inaccurate

Performance Variables:

  • System performance may fluctuate based on technical factors and usage patterns

No Guarantee of Results

We do not guarantee:

  • Specific lead generation volumes or quality levels
  • Particular conversion rates or business outcomes
  • Perfect accuracy in AI analysis or lead scoring
  • Continuous availability without interruption

Human Oversight Recommended

You should:

  • Review and verify AI-generated lead assessments
  • Implement human oversight for important business decisions
  • Validate contact information before use in business operations
  • Use AI insights as decision support tools, not replacement for human judgment

7. Data Handling and Privacy

Data Processing

Our data handling practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our service, you also agree to our Privacy Policy.

As a business customer, you are responsible for:

  • Account data: Retained until account deletion or as required by law
  • You may request earlier deletion of specific data categories

8. Service Availability and Support

Uptime and Maintenance

We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or improvements that temporarily affect service availability. We will provide reasonable notice for planned maintenance when possible.

Customer Support

Support availability varies by subscription plan:

  • Basic Plans: Email support with 48-hour response time
  • Professional Plans: Priority email support with 24-hour response time
  • Enterprise Plans: Email and phone support with 8-hour response time

Support covers:

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

10. Termination

Termination by You

You may terminate your account at any time by:

  • Cancelling your subscription through your account dashboard

  • Providing written notice of termination

Upon termination:

  • You will retain access to services through the end of your current billing period
  • No refunds will be provided for unused portions of prepaid subscription fees

Effect of Termination
